Courts Can Ignore Arbitration Clause in Consumer Contracts Under Certain Circumstances

The Appellate Division has agreed to reinstate a construction defect case wich was proceduraly dismissed because of a trial court’s decision to uphold an invalid arbitration clause.  The decision remands the case back to the trial court.
